Terms of Service

The rules for using Zylo Dispatch's website, apps and dispatch service. Please read them before you book a load.

Agreement

By creating an account or using Zylo Dispatch you agree to these terms and to our Privacy Policy. If you use the service for a business, you confirm you can bind that business. Text messaging has its own consent and terms in the SMS Terms, which are separate from this agreement.

The service

Zylo Dispatch provides managed dispatch for U.S. owner-operators and small fleets. Our dispatchers find and negotiate loads and present offers. Our software recommends; a dispatcher decides; the driver executes. Nothing is booked for you without your approval. We are not a motor carrier, broker or freight forwarder, and we do not haul freight.

Your account and responsibilities

  • Give accurate information and keep your documents, authority and insurance current.
  • Keep your sign-in details and verification codes private and tell us if you suspect misuse.
  • Operate lawfully, including FMCSA, hours-of-service and safety rules. You remain responsible for the safe operation of your equipment.
  • Do not misuse the service, interfere with it, or use it to break the law.

Fees and payment

Dispatch fees are set in your service agreement. Rates quoted on loads are set between you and the broker or shipper. We are not responsible for a broker's or shipper's failure to pay, except as your agreement says.

Our intellectual property

The service, software and content belong to Zylo or its licensors. You may use them only to receive the service.

Disclaimers and liability

The service is provided “as is” and “as available”. To the fullest extent the law allows, Zylo Dispatch is not liable for indirect, incidental or consequential damages, lost profits or delays outside our control, and our total liability is limited to the fees you paid us in the 3 months before the claim.

Ending the service

You may stop at any time. We may suspend or end access if you break these terms, or the law requires it. Terms that should survive, such as payment and liability, do.

Changes and governing law

We may update these terms and will post the change here; continued use means you accept it. These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.
